General Conditions of Sale SAOLA SAS, company with capital of 10 000 € whose registered office is located at 12 C Rue du Pré Faucon, 74600 Annecy Le Vieux, registered with the RCS of Annecy under No. 823558689, hereinafter "Saola ", And people wishing to make a purchase, hereinafter referred to as the" customer ", via the website http: //www.saolashoes.com

II. MODALITY OF ONLINE PURCHASE & PRICE

Order process

The different steps to be followed by the customer to place an order on the website www.saolashoes.com are :

8) Confirmation email: The customer will then receive an order confirmation email, which will include all the information of his order as well as a tracking number of parcels.

Create an account :

To create his personal account, the customer must provide his name and surname, his mailing address, his e-mail address and his telephone number. A password will then be asked. The customer can choose the payment method hi prefer :

Shipping and delivery time

The shipping times below represent the number of days required to prepare the order, from receipt of payment :

Shipping in France, Corsica, Principality of Monaco: 5 working days maximum

Shipping to other countries of the European Union: 5 working days maximum

For other customers who do not reside in any previous country, we unfortunately do not deliver to you yet.

V. RETRACTION & RETURNS

Terms :

The customer has a period of 30 days from the delivery of his order to return SAOLA products. If this period expires on a Saturday, Sunday or a holiday, it’s extended until the next business day. This policy is not applicable for sale products.

For this, the product must be returned in its original packaging, in its original condition, new, unworn, unwashed, undamaged or soiled, and must not have been prolonged use (beyond the time required for testing). The return is made at the risk of the Customer, and a tracking number is requested to ensure the delivery of the product. Returns that do not comply with these requirements will not be accepted.

Procedure :

To inform SAOLA of its return request, the Customer may use the following way, before expiry of the deadline:

  • Online, by logging into its Customer Area in the "My Order History" section following the procedure. In this case, an acknowledgment of receipt of your request will be sent to you.
  • By returning the duly completed and signed withdrawal form to the following address SAOLA Shoes, 12C Rue du Pré Faucon, 74600 Annecy Le Vieux
  • By any other ways that the customer wishes to use

The customer must indicate his name, order number, date of order, and specify whether his request is for a refund or an exchange. In the case of an exchange, the customer is asked to specify which size / color he wishes.

Costs :

  • In case of exchange :

If the Customer wishes to exchange his shoes, SAOLA accepts changes of size or color. The returns and the shipping of the new chosen product are free in France, and also for those of the other member countries of the European Union (including the United Kingdom and Switzerland) which benefited from a free delivery (order superior to € 150)

In other cases, the return is the responsibility of the customer.

  • In case of refund :

In the case where the customer wishes to return SAOLA products, in order to be refunded, the return is the responsibility of the customer, regardless of his country of residence.

Once the product is returned to us, Saola undertakes to refund you as soon as possible, the full payment received (with the exception of additional charges if you have chosen a delivery method other than the standard one ). We will refund using the same method of payment that you used in your transaction, no later than 14 days after the date of receipt of returned products.

VI. LEGAL GUARANTEES

SAOLA products benefit from the legal guarantee of conformity (Article L 217-4) in accordance with the Consumer Code, and the guarantee of hidden defects (Article 1641) in accordance with the Civil Code. Any guarantee is excluded in case of damage from external sources or due to misuse, improper use, negligence or lack of maintenance on the part of the Customer, as in case of normal wear of the product.

  • Article L217-5 of the Consumer Code:

To be in conformity with the contract, the property must:

1º Be fit for the usual expected use of a similar good and, where appropriate: correspond to the description given by the seller and possess the qualities that he presented to the buyer in the form of a sample or a model ; present the qualities that a buyer may legitimately expect given the public statements made by the seller, the producer or his representative, including advertising or labeling;

2 ° Or have the characteristics defined by mutual agreement by the parties or be fit for any special purpose sought by the buyer, made known to the seller and that the latter has accepted.

  • Article L217.7 Consumer Code

The defects of conformity which appear within twenty-four months from the delivery of the good are presumed to exist at the time of the delivery, unless proven otherwise.

The seller can combat this presumption if it is not compatible with the nature of the good or the lack of conformity invoked.

  • Article L217-9 Consumer Code

In case of lack of conformity, the buyer chooses between repair and replacement of the goods. However, the seller may not proceed according to the choice of the buyer if this choice entails a cost obviously disproportionate with respect to the other modality, taking into account the value of the good or the importance of the defect. He is then obliged to proceed, unless it is impossible, according to the method not chosen by the buyer.

  • Article L217.10 Consumer Code

If the repair and replacement of the property are impossible, the buyer can return the property and get the price back or keep the property and get a part of the price.

  • Article 1641 of the Civil Code

The seller is bound by the guarantee by reason of the hidden defects of the thing sold which render it unsuitable for the use for which it is intended, or which diminish the use so much, that the buyer would not have acquired it, or not would have given a lower price, had he known them.

  • Article 1648 paragraph 1 of the Civil Code

The action resulting from the latent defects must be brought by the purchaser within two years from the discovery of the defect.

VII. INTELLECTUAL PROPERTY

As such, and in the absence of prior written permission by SAOLA, the partial or total reproduction of the site saolashoes.com is strictly prohibited.

VIII. RESPONSIBILITY

SAOLA is committed to the proper execution of the contract concluded with the Customer. However, SAOLA can not be held liable for non-performance or improper performance of the contract concluded in case of force majeure, the occurrence of an event attributable to the Customer or any inconvenience, unforeseeable and insurmountable damage inherent in the use Internet network, including a break in service, an external intrusion or the presence of computer viruses.

IX. MEDIATION OF CONSUMPTION
